Rights of Assisted Living Residents in Israel

The Legal Framework

Residents of licensed assisted living facilities in Israel have enforceable legal rights under the Patients Rights Law (1996), Ministry of Health licensing regulations, and the specific Diur Mugan regulations. These rights apply regardless of what the facility's contract says — contractual terms that contradict these minimum standards are unenforceable.

Core Rights of Residents

  • Dignity and respect: Every resident is entitled to be treated with dignity, regardless of cognitive or physical condition. Verbal or physical mistreatment is a criminal offence.
  • Privacy: Residents have a right to privacy in their room, in communications, and in medical information.
  • Autonomy: Residents with capacity have the right to make their own decisions about daily life, diet preferences, social activities, and visitors.
  • Medical information: Residents have the right to understand their medical condition and to give informed consent to treatment.
  • Complaint procedure: Every facility must have an internal complaints procedure, and residents may file complaints with the Ministry of Health's Health Supervision Unit.

What can I do if an assisted living facility in Israel violates a resident's rights?

You can file a complaint with the facility's internal complaints officer, escalate to the Ministry of Health's licensing supervisor for that facility, or contact an attorney to pursue a civil claim for damages. In serious cases involving abuse or medical negligence, a police report may be warranted. The Ministry of Health has authority to impose fines, require corrective measures, or revoke a facility's operating licence in egregious cases.
